GENERAL CONDITIONS OF SALE & GENERAL CONDITIONS OF USE

Article 1: object

Armaille.com (hereinafter referred to as « the Website » or Armaillé Paris) is published and operated by the company Armaillé Paris, having its registered office at 16 RUE GUYENNE 02820 SAINT-ERME-OUTRE-ET-RAMECOURT, with the share capital of € 10,000, registered in the Companies Register under number 880 297 916, and whose intra-community VAT number is as follows: FR 84 880297916.

Article 2: Acceptance of the general conditions

The acceptance of the general conditions of sale is carried out tacitly by the validation of the order by the customer. By making the payment, the user indicates that he fully accepts these general conditions.

Article 3: Products

The Products are all the goods offered for sale by Armaillé Paris on the Website within the limit of available stocks.

Armaillé Paris does not incur any responsibility in the event of a stock shortage or unavailability of Products for orders not yet accepted by Armaillé Paris. Errors or modifications may exceptionally exist, in particular in the case of simultaneous orders of the same Product by several Customers. In the event of unavailability of a Product after placing your order, the customer is informed by e-mail or telephone as soon as possible, proposing either to order another Product presented on the Website as a replacement, or to cancel and refund your order.

Armaillé Paris ensures the presentation and description of its Products is correct in order to best satisfy the Customer’s information. However, it is possible that errors may appear on the Site, which the Customer acknowledges and accepts. Armaillé Paris does not guarantee the accuracy or security of information transmitted or obtained by means of the Site.

Article 4: Realization of sales

Customers have the option of ordering on the Website at www.armaille.com. Ordering on the Website is subject to compliance with the procedure put in place by Armaillé Paris, embodied in a succession of steps that the Customer must follow leading to the validation of his Order. The validation of the Order constitutes confirmation of the acceptance by the Customer of the GTCS, the Products purchased, their price as well as the associated costs. A confirmation of the order validated by the Customer will be sent to him by e-mail prior to the dispatch of the order, and will make the sale final, subject to the right to exercise the right of withdrawal. To this end, the Customer formally accepts the use of electronic mail for confirmation by Armaillé Paris of the content of his Order. When placing the order, the Customer must ensure the accuracy and completeness of the data he provides. In the event of an error in the wording of the recipient’s contact details, Armaillé Paris cannot be held responsible for the impossibility of delivering Products.

Sales are perfect between the parties and title passes to the purchaser upon full payment for the item, regardless of the date of delivery.

Article 5: Information obligations

Armaillé Paris fulfills its duty of advice and pre-contractual information as it derives from article L121-18 of the Consumer Code and the articles to which it refers.

The essential characteristics of the articles are given in the detailed description accompanying the photographs of the articles.

Compliance with article L121-19 of the Consumer Code results from the confirmation of the order.

Article 6: Customer account

The site is freely accessible without compulsory registration, but any order requires the registration of the purchaser. The following must be requested: title, first name, last name, email address, a password, telephone number and delivery address – in order to proceed with the sale and delivery of the products.

Article 7: Price and means of payment

The prices are indicated all taxes included in France and in the European Union. Payment is made by credit card and debit card, through the Stripe payment interface.

Payment data is not kept by Armaillé Paris. The price collection is immediate.

The information that you communicate to us during your order and your payment by credit card is subject to automated data processing by our partner Stripe. The purpose of this automated data processing is to define a level of analysis of transactions and fight against credit card fraud, theft and misuse of your identity.

STRIPE and Armaillé Paris are the recipients of the data relating to your order. Your card number is never transmitted or used as is but benefits from a secure encoding and encryption system. The highest security standards are applied to data storage and all comply with the Payment Card Industry Data Security Standard (PCI DSS).

The occurrence of an unpaid due to fraudulent use of a bank card will result in the registration of contact details in connection with your order associated with this unpaid within a payment incident file. An irregular declaration or an anomaly may also be the subject of specific processing.

Depending on the information provided by the order analysis system, we may need to contact you to ask you to provide us with additional documents. The supply of these documents is in this case a sine qua non for the validation of your reservation.

In order to fight against credit card fraud, a visual verification of the means of payment can be carried out by the customer service of Armaillé Paris before shipment of the products.

Article 8: Prices and delivery time

Delivery costs are determined at the time of ordering.

The delivery times indicated depend on the possibilities of supplying the products, they are understood in working days. The Products are shipped to the delivery address indicated by the Customer. Armaillé Paris cannot be held responsible in the event of an incorrect or incomplete address provided by the Customer.

Delays in delivery cannot give rise to damages.

Article 9: Unavailability of the goods ordered

If, exceptionally, the item ordered is no longer available, the buyer may either proceed with an exchange or be reimbursed without delay and at the latest within thirty days of payment of the sums paid.

It emerges from article L121-20-3 of the Consumer Code, that Armaillé Paris, as a professional, is legally responsible towards the consumer for the proper performance of the obligations resulting from the contract concluded at a distance, that these obligations are to be performed by the professional who concluded this contract or by other service providers, without prejudice to his right of recourse against them; on the other hand that he can be exonerated from all or part of his responsibility by providing proof that the non-performance or poor performance of the contract is attributable, either to the consumer, or to the fact, unforeseeable and insurmountable, of a third party to the contract, or to a case of force majeure.

In the event of an anomaly noted on delivery, that is to say in the event of defective or non-conforming items in kind (color reference error), the Customer must as soon as possible or even on the day of the delivery, send complaints to Armaillé Paris by email, to the following address: contact@armaille.com

Any complaint formulated beyond 3 days following delivery cannot be accepted.

The absence of complaints, the non-issuance of reservations by the Customer means that the item delivered is deemed satisfactory and cannot be the subject of any subsequent dispute.

Article 11: Cancellation: Right of withdraw

At the end of article L 121-20 of the Consumer Code as amended by ordinance n ° 2001-741 of 23 August 2001 and law n ° 2014-344 of 17 March 2014, the withdrawal period is 14 days from the day after receipt of the item.

The exercise of this right entails the reimbursement of the sums paid, after qualitative and quantitative verification of the returned items.

Article 12: Returns

In France the return costs are the responsibility of Armaillé and outside France the return costs are the responsibility of the customer.

In all cases, the return costs are the responsibility of Armaillé Paris if the Product delivered to the Customer is different from the Product ordered or if it is delivered damaged.

The products must be in good condition and returned to their original packaging, to which is added packaging covering the entire product; they must not bear any traces of use, be accompanied by their accessories.

It is only after verifying that these conditions are met that Armaillé Paris will reimburse the sums collected for the returned items, with the exception of the initial shipping costs. Otherwise, no refund can be due, the customer will remain the owner of the product, which will be returned to him as soon as possible.

Article 14: Intellectual property

All texts, comments, works, illustrations and images, whether visual or audio, reproduced on the armaille.com site are protected by copyright, trademark law, patent law and image rights. , and this for the whole world. They are the full and entire property of Armaillé Paris.

As such and in accordance with the provisions of the Intellectual Property Code, only use for private use subject to different or even more restrictive provisions of the Intellectual Property Code, is authorized. Any other use constitutes an infringement and is punishable under Intellectual Property.

Article 15: Litigation

Any disputes that may arise on the execution and interpretation of these general conditions must be brought before the courts of Paris, which will have sole jurisdiction.

Armaillé Paris reserves the right to modify certain elements of these general conditions during the year.
